BOOKING CONDITIONS

This contract represents the entire agreement between the parties and replaces all prior understandings (oral or written) covering the subject matter. A booking entails an acceptance of this contract by the Client.
Arrival and Departure
The minimum rental period is generally one week, from Saturday to Saturday.
Arrival: Unless otherwise agreed, Client should arrive on Saturday between 4,00 PM and 8,00 PM; Departure: Unless otherwise agreed, Client should vacate the property on Saturday by 10,00 AM.
Every change of arrival/departure date and time must be communicated to Positano Vacanze & Turismo not less than 10 days before arrival and be approved by Positano Vacanze & Turismo.
Late on arrival
For late arrival after 8.00 PM up to 11.00 PM, Sundays and Italian bank holiday arrivals is required an additional fee of €25,00 (due to outside of normal office hours).
For arrival after 11.00 PM the additional fee is € 50,00 to be paid locally at the check-in.
Number of Occupants
The total number of guests staying at the property may not exceed the number of sleeping places specified in the property information (all promotional materials). The owner reserves the right to refuse entry or evict the entire party if the number of persons occupying a property exceeds the number stipulated in this contract.
Payment
If booking more than 30 days in advance of the rental period: The Client shall pay a deposit of 25% of the total rental amount within the 3 days option, in order to reserve the property; The balance is due minimum 30 days before the rental period. After full payment of the contract price, Positano Vacanze & Turismo will supply the Client with an arrival voucher and additional information required to occupy the property. If the payment of the remaining balance is not received on this deadline (minimum 30 days before arrival), the booking is considered CANCELLED without further notice.
If booking less than 30 days before the rental date: the whole amount shall be paid within the 3 day option, in order to reserve and fully book the property for the choosen period. After full payment of the contract price, Positano Vacanze & Turismo will supply the Client with an arrival voucher and additional information required to occupy the property. If the payment of the whole amount is not received within the 3 days option, the booking is considered CANCELLED without further notice.
SMART OFFER: For some properties we are able to offer Smart Prices, which are more convenient rates for a specific time frame. The whole amount is to be paid at the moment of the booking and it is not refundable.
Methods of payment
All payments must be made in Euro. The Client can choose to pay:
- with a bank transfer to the Positano Vacanze & Turismo's bank account;
- by credit card, with our secure on-line system. There may be an extra fee for this method of payment.
Rental voucher
The voucher will be sent to the Client after receipt of the balance which must arrive at least 30 days before the beginning of the rental period. The Client will print the voucher and show it to the Owner (or his/her representative) at the check-in.
Security Deposit
A security deposit (amount as stipulated on the rental voucher) must be paid IN CASH to the Owner or his/her representative for eventual damages that may occur to the property. This deposit will be refunded to the Client at the end of the holiday, less any deduction made for eventual damage caused to the property, or for any additional cost not included in the letting price (such as final cleaning, extra linen, parking, etc..). If no damages occur and no extra costs have to be paid, the entire amount will be completely returned to the Client.
Client Responsibility
The Client is responsible for ensuring the property is left in a reasonable condition of cleanliness and repair as upon arrival, even if the final cleaning is included in the rental price. Clients are required to act with respect towards the neighbors, the Owner and their staff. Any loss or damage to the property will be charged to the Client. The Client acknowledge that between 11,00 PM and 8,00 PM any loud noise has to be made, in order to respect the common rules. Animals are not admitted in the lodgings unless other agreements have been taken. The Owner and Positano Vacanze & Turismo reserve the absolute right to require any individual to vacate a property for disruptive behavior, in this case there would be no refund of any rental payment.
Cancellation Charges
All cancellations by the Client must be in writing and become effective on the date of receipt by Positano Vacanze & Turismo. Cancellation charges as follows:
- on receipt of the cancellation letter 30 days or more before the start of the rental period, the Client will get a refund of 20% of the paid deposit.
- on receipt of the cancellation letter from the 29th to the 16th day before the start of the rental period, the Client will get a refund of 15% of the paid rental amount.
- on receipt of the cancellation letter LESS than 16 days before the start of the rental period the Client will get no refund.
If the Client books with a SMART OFFER, the whole amount is not refundable.
For more luxury properties special conditions of pre-payments are applied as well as a different Cancellation Charges, as specified on the property's page.
Promotional Information
Positano Vacanze & Turismo has visited and periodically visit each property. Positano Vacanze & Turismo has taken care to ensure the accuracy of all information and descriptions contained in its promotional material at the time prepared. However, nothing in those materials shall be treated as a term or condition of this contract and Positano Vacanze & Turismo declines all responsibility for modifications made by the Owner without its knowledge.
Positano Vacanze & Turismo shall not be liable for temporary defects or stoppages of any utilities. And also, properties may not always appear exactly as pictured or described due to normal tear, changes in furnishings and changes after materials were prepared.
Complaints
In the even of any problem, the Client must notify the property Owner or his/her representative and Positano Vacanze & Turismo within 24 hours. Failure to do so will void any claim following the rental period. The Client should allow the Owner or his/her representative and Positano Vacanze & Turismo reasonable time to resolve the problem. If the Client vacate the property without Positano Vacanze & Turismo authorization, He/She will not receive any refund of the letting cost.
Changes or Cancellation by Owner or by Positano Vacanze & Turismo
Positano Vacanze & Turismo reserves the right to modify or cancel this contract at any time in any case of a force majeure, or any other event outside the control of Positano Vacanze & Turismo. In the event of any change or cancellation by the property Owner, Positano Vacanze & Turismo shall inform the Client promptly and reserve the right to transfer him/her, upon agreement, to a similiar property. If the Client do not accept the substitute property, Positano Vacanze & Turismo will cancel this contract and will refund to the Client only the money paid for his/her booking (the letting price he/she paid), no other refund.
Disclaimer
Positano Vacanze & Turismo does not own any rental accommodations and only act as agent for the Owner of the property. Positano Vacanze & Turismo does not accept liability for any accident, loss, injury, damage, sickness, death, alteration, inconvenience arising from the rental, except insofar as that occurrence is caused by the direct negligence of Positano Vacanze & Turismo. Positano Vacanze & Turismo does not accept liability for any loss or damage caused by weather conditions, natural disaster, riot or any cause beyond its control.
Jurisdiction
This contract shall be governed by Italian law. In the event of controversy arising from the booking and the letting, only the Courts of Law in Salerno city and the provisions of Italian Civil Law can deal with the matter and only Italian law applies.
